Immigration Services Funding in the College of Liberal Arts & Sciences

Purpose: 

To assist with the recruitment of highly qualified international faculty members in the College of Liberal Arts & Sciences.

Policy Statement: 

To assist its departments, programs, centers, and schools with the recruitment of highly qualified international faculty members, the Dean’s Office of the College of Liberal Arts & Sciences provides centrally allocated College funds for certain fees associated with hiring persons who are not currently eligible to work in the United States. The Dean’s Office provides these funds for persons who will be employed as tenured or tenure-track faculty members, or as teaching professors of any rank (assistant, associate, or full).

Some other fees are not provided by the Dean’s Office, but may be provided by College departments, programs, centers, and schools at their discretion.

H-1B Petitions

The Dean’s Office provides funds for the following fees:

  • $460 fee for Form I-129, Petition for a Nonimmigrant Worker. The university uses this form to enable the employee to come to the U.S. to perform services or labor, or to receive training. This fee can be paid out of state funds.
  • $500 Fraud Prevention and Detection Fee. This is a required employer fee. It can be paid out of state funds.
  • $1,440 fee for Form I-907, Request for Premium Processing Service. The Dean’s Office provides funds for this fee only if necessary for employment purposes. It can be paid out of state funds.
  • $1,237 fee for KU International Affairs to process an H-1B petition.

The Dean’s Office also provides funds for the $460 fee for applying for an extension of H-1B status, which is typically obtained in 3-year increments. Like the $460 fee for the original H-1B application, this fee can be paid out of state funds.

H-4 Petitions

The Dean’s Office does not provide funds for fees for applications to obtain or extend H-4 status for dependent family members who are already in the U.S.

  • These fees may be paid by a College department, program, center, or school at their discretion.
  • These fees cannot be paid out of state funds but can be paid out of private funds (e.g., KU Endowment Association funds).
  • If these fees are paid by a College department, program, center, or school, the university must report the payments to the I.R.S. as a taxable benefit provided to the employee.

Permanent Residency Petitions

Special Handling Labor Certification

The university files the Special Handling Labor Certification, if applicable.

Immigrant Petition (Form I-140)

The Dean’s Office provides funds for the following fees, but no more than once per faculty member.

  • $700 fee for Form I-140, Immigrant Petition for Alien Workers. The university uses this form to enable the employee to become a permanent resident in the U.S. Depending on the circumstances, the university may need to report this payment to the I.R.S. as a taxable benefit provided to the employee.
  • $1,440 fee for Form I-907, Request for Premium Processing Service.
    • The Dean’s Office provides funds for this fee only if necessary for employment purposes.
    • This fee cannot be paid out of state funds but can be paid out of private funds (e.g., KU Endowment Association funds).
    • If this fee is paid, the university must report the payment to the I.R.S. as a taxable benefit provided to the employee.
  • $2,586 fee or $2,010 fee for KU International Affairs to process an immigrant petition.

Adjustment of Status Application (Form I-485)

The Dean’s Office does not provide funds for the $1,225 fee for Form I-485, Application to Register Permanent Residence or Adjust Status.

  • This fee may be paid by a College department, program, center, or school at their discretion.
  • This fee cannot be paid out of state funds but can be paid out of private funds (e.g., KU Endowment Association funds).
  • If this fee is paid by a College department, program, center, or school, the university must report the payment to the I.R.S. as a taxable benefit provided to the employee.
  • This form must be filed by the employee, not the university. Although the university does provide information to aid the employee with this process, the employee may wish to seek the services of an immigration attorney to represent the employee and file this petition on their behalf.
